有媒体报导,部分海外买主将所买房产置于企业或亲戚名下,以规避物业交易税(property transfer tax),省府将研议对策,严管此一逃漏税行为。另一方面,在联邦层级对海外税务及资本利得等的查缉,则显得脚步蹒跚。 《环球邮报》日前专文报导,不少海外买家以亲友、子女之名来加置产的现象,并以温哥华房地市场为报导主击,指出在以华人为主要海外投资买主的温哥华房地市场中,有三分之一的高端房产海外买主,将房产登记在他人名下,除少缴物业交易税外,也刻意隐藏身分,躲避税务追查。 在卑省,企业信讬人之间物业的转让,不算改变拥有权,也就规避了交易税,安省已经防堵该漏洞,卑省财政厅长麦德庄(Mike de Jong)则回应说,省府将在下一个预算年度跟进这一作法,并可能同时对最高端的豪宅增税,借以对低端买主提供税负减免。 ‧海外投资客钻洞避税 非常普遍 移民律师海曼(Sam Hyman)以第一手经验指述这种避税情况非常普遍。他说,加国以不积极追查逃漏税及防范洗钱着称,海外富人闻风而来,钻漏洞逃税。 环球邮报在检视过200宗离婚或其他争议官司后,发现有些来自海外的物业业主住的是「亲戚」所拥有价值数百万的豪宅,却告诉庭上他的年收入不到3万元。 这些人当中有些是非税务居民,因此仅需申报加国境内的所得,但这一部分收入很少或根本没有,但他们海外的财富则「赠与」他们年长的父母或年幼的子女买豪宅,除了享受房税优惠,在卖房时又因自住而免课资本利得税。 ‧国税局查税 自断手脚 国税署回应环球邮报对海外买主逃漏房产相关税务的询问,说「多宗案件正在调查」,但联邦税务稽查员工会则指该署事实上已「自断手脚」。 工会方面指出,最近才有262名稽查从国际部门转调国内稽查部门。工会代表毕特曼(Shannon Bittman)说,这些稽查员经多年训练,完全有能力决定这一类人的税务身分及义务。 一位前税务稽查员说,加拿大与中国的税务协定已经过时,不只无法查证这些买家在中国的所得,即使要在加国国内查他们的帐户都变得困难而无效率。 国税局回应上述批评表示,国税局已采取多种手段防止逃漏,防范海外税务严重违犯事件,对违法情事,决不宽容。 图片取自 Wolf of Wall Street
自住房出租,可以补贴一些家用,但是如果不安排好,税务也许会成为大问题。不过这里我先声明,我仅仅是讨论,不构成任何专业意见。还是那句话,最好咨询专业会计师。看了下,这篇文章是2015年写的,4年后,我来更新一下吧。 什么是自住房 (Principal Residence):自住房,简单的这么理解,你自己住的房子。而且一段时间只有一套自住房。复杂的来说,作为自住房有下面四个要求: 第一、必须是房子(含独立屋、半独立屋、镇屋、公寓等); 第二、房子必须用于自住; 第三、必须是加拿大人(含加拿大公民和永久居民)拥有; 第四、面积有限制,一般说来,所占的土地面积不能超过0.5公顷或1.25英亩参考:How does a property qualify? 那么自住房最大的特点是什么呢?就是免增值税(Capital Gain Tax Free)。那么自住房出租所带来的问题是什么呢?我想最大的问题就在于,长时间的出租,出租的部分,就无法免增值税了。所以这就有一个你需要去衡量的部分了。你的房子出租的收入能否抵消未来你的房子增值的税。这个问题相对就比较复杂了。比如说你的房子的30%出租,房子买的时候价值80W,预期3年内卖掉可以获得100W。预期收益20W,作为自住房,这部分的收益是全部可以免掉的。但是你把房子的30%出租,租金为每个月2000元,3年的收益为7.2万元。那么你会得到下面一个情况:自住房,无租金收入,卖房无税务支出出租30%,租金收入7.2(税后估计4.5W左右),未来卖房税务支持,2050%30*40%(你的个人税率)=4W的税务支出。这是比较理想的状态下。你获得了0.5W的收益。所以这笔帐,我觉得需要你自己去算了。 下面有一些点需要留意,自住房出租, 装修费不能抵税, 维修费才能抵税, 家具不能抵税, 地税和贷款利息不能抵税, 水电气CABLE只能按不超过50% 的费用抵税. 就自住房用于出租这一项,税法有一个特别的规定,您可以有4年的时间全部出租您的住所,但仍然指定该房产为自住房,因此在售房时也就无需申报房产增值的部分。 需要注意的是,在出租期间,报税时不可以申报房屋折旧,否则有可能改变您住所自住房的性质而失掉增值免税额。在出租期间,您也不可以指定其他的房产为自住房。如果您是由于工作地点变化的原因而搬离您的主要住所而将其出租,该期限还可申请延长,但最终您或您的家人必须要重新入住才能保持其自住房的性质。相关的材料可以查看CRA的网站:Changing all your principal
